TERMS AND CONDITIONS Welcome to www.mawi.co.uk. These general terms and conditions of use govern the access to and use of www.mawi.co.uk. The access to and use of this Website as well as the purchase of products on www.mawi.co.uk are based on the assumption you have read, understood and accepted these general terms and conditions.

If you require any information regarding shipping, refunds and returning purchases from www.mawi.co.uk, please refer to these Terms and Conditions as well as our Contact Page. On the Contact Page you will also find a customer registration form, tips and other general information on the services provided by www.mawi.co.uk. These Terms and Conditions, together with our Website prices, delivery details, contact details and privacy policy set out the whole of our agreement relating to the supply of the Products by us. Nothing said by any sales person on our behalf should be understood as a variation of these Terms or as an authorised representation about the nature or quality of any Products offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

If any clause or section of a clause in these Terms is held by any Court of competent authority to be unlawful, invalid or unenforceable, such clause or section shall be removed and the remaining Terms shall remain in full force and effect.

MAWI Limited may correct any typographical, clerical or other error or omission in any information on the Website or in any email or other document or communication issued by MAWI Limited without incurring any liability on our part. MAWI Limited also has the right to amend or update all or part of these Terms and Conditions at any time. Any amendment or update of the general Terms and Conditions of use shall be posted for users' attention on the homepage of www.mawi.co.uk and are binding as soon as they have been updated on the Website. Therefore we strongly recommend that you regularly access the Terms and Conditions section of this Website in order to check the publication of the most recent and updated general Terms and Condition of use of www.mawi.co.uk. However, these variations will not affect any Contract between MAWI Limited and you. Continued use of the Website, or any of its services will signify that you agree to any such changes.

These Terms govern the contract to the exclusion of all other terms and conditions stipulated in any other communication or document unless expressly agreed in writing by MAWI Limited.

The contract between you and MAWI Limited shall be governed by English law and you and MAWI Limited submit to the exclusive jurisdiction of the English Courts.

The access to and use of www.mawi.co.uk, including display of web pages, communication with provider, downloading product information and making purchases on the Website, are carried out by our users exclusively for personal purposes, which should in no way be connected to any trade, business or professional activity.

On accessing www.mawi.co.uk you agree to use the website only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the Website. REGISTRATION

In order to use some of the features or services made available on this Website you will need to register. When you register with www.mawi.co.uk you are required to provide information about yourself that is true, accurate, current and complete in all respects. Should any of your information change at any time, please notify MAWI Limited by emailing customerservice@mawi.co.uk. MAWI Limited also has the right to change registration requirements at any time. The account password you provide should be unique and kept secure, and you must notify MAWI Limited immediately in the event of any security breach or unauthorized use of your account. PRICING

The price of each MAWI Limited product will be as stated on www.mawi.co.uk at the time the order is submitted. Prices shown on the Website are in British Pounds Sterling (GBP), Euros or US Dollars. Prices are inclusive of VAT at the applicable rate, unless you have selected an alternative country where VAT is not chargeable. MAWI Limited product prices are set at the beginning of each season using existing currency exchange rates. These prices are subject to change if the applicable currency exchange rate changes before orders are accepted, or the items are subject to markdowns at any point during the selling period. If we discover an error in the price of any of the products offered we will contact the customer to resolve the situation. Product pricing does not include the cost of delivery and freight insurance, as that cost is dependent upon the value of the item(s) purchased and so is advised in addition to the prices stated. Customers purchasing from a country served as DDP (Delivered Duty Paid) will incur relevant import duty and tax. These costs are included in the final purchase price. Customers purchasing from a country served as DDU(Delivery Duty Unpaid) will be charged for the items purchased and shipping costs only. It is recommended that you contact your local customs authority prior to purchase completion in order to determine a landed cost price. All MAWI Limited products must be paid for in full before being dispatched. In the occasion that an irregularly small or large size is requested, or for custom works or any other type of special order, you will be required to pay an additional cost alongside the price originally offered on the Website. This additional price will be declared when submitting the order. Please be aware that by making an enquiry you are held under no obligation purchase any product, however you do agree to be bound by our Privacy Policy.

ORDER ACCEPTANCE AND PAYMENT

Once you have selected your choice and your order has been placed, you will receive an email from MAWI Limited outlining the details of your order. This is only to acknowledge that we have received your order, NOT an acceptance or confirmation. Before your order can be finalised, MAWI Limited must receive cleared funds or confirmation of the authorisation of the payment. Once payment has been received we will confirm that the order has been accepted by sending an Order Confirmation to your email address previously provided. The acceptance of your order brings into existence a legally binding contract between you and MAWI Limited. Unless you cancel your order, acceptance of your order and completion of the contract between you and MAWI Limited will be completed when you receive a confirmation email to confirm that the items have been dispatched. MAWI Limited accepts payment in British Sterling (GBP), Euros or US Dollars on www.mawi.co.uk. MAWI Limited products must be paid for using any method currently specified on the Website, which may include without limitation; Credit or debit card by communicating your card details to MAWI (the credit/debit cards accepted by us are those listed on the Website on the date your order is placed). In the event that payment for an order is not received, you are not fully entitled to use your nominated credit, debit or charge card, or such card has insufficient funds to cover the cost of the order then MAWI Limited may contact you allowing you to make payment in full within a specified time period by the same of other means. Alternatively, MAWI Limited may at its sole discretion cancel your order. In the event of an order cancellation, MAWI Limited will return any payment received from you within 30 days of receipt of such monies to your nominated account. You agree that in any event that MAWI Limited has no liability to you for any loss, damage, costs, expenses or any other claims that you may incur. You agree to compensate MAWI Limited in full against all costs and outgoings incurred by MAWI Limited in obtaining payments from you in the event a failed payment occurs.

OUR RIGHT TO CANCEL

MAWI Limited reserves the right to cancel your order if: One or more of the items you ordered was listed at an incorrect price due to a typographical error in the pricing information received by us from our suppliers or for any other reason; A Force Majeure Event occurs. Force Majeure defines an event that is caused from the elements of nature rather than human behaviour. If we do cancel your order we will notify you by e-mail and will offer an alternative replacement product or refund to you any amounts paid as soon as possible, in any event within 30 days of your order. MAWI Limited is not obliged to offer any additional compensation for disappointment suffered and we have no liability to you for any loss, damage, costs, expenses or other claims that you may incur. We also reserve the right not to accept your order in the event, for example, that we are unable to obtain authorization for payment, that shipping restrictions apply to a particular item, that the item ordered is out of stock or does not satisfy our quality control standards and is withdrawn, or that you do not meet the eligibility criteria set out within the Terms and Conditions.

DELIVERY

As part of our insurance requirements and quality control procedure, before any MAWI product is shipped the item is inserted into the correct packaging in the presence of a suitable individual and duly sealed. Delivery will be made to the address specified in the Order Confirmation. MAWI Limited reserves the right to restrict the delivery of Products to certain areas. We will take all reasonable steps to deliver your order to you on or before the date specified in the Order Confirmation but delays may be caused and delivery can be delayed due to Force Majeure Events or any other reason, and MAWI Limited does not warrant or guarantee the delivery date specified in the Order Confirmation and shall have no liability to you for any loss, damage, costs, expenses or other claims that you may incur as a result of late delivery. The delivery time of the products shall not be of the essence of the contract. You will become the owner of the products you have ordered when they have been delivered to you. Once the products have been delivered to you they will be held at your own risk and MAWI Limited shall not be liable for their loss or destruction. For specific product shipping and delivery procedures please consult the Shipping Section. Please read the Shipping Section carefully. The information provided in the Shipping Section forms an integral part of the www.mawi.co.uk general Terms and Conditions and shall be deemed to be fully read and accepted by you at the time your order is made.

RIGHT OF CANCELLATION

Except for the products that are special bespoke orders, you will be entitled to cancel your order by written notice by post to MAWI sales department Independent Place, LONDON E8 2HE or by email to customerservice@mawi.co.uk giving details of the goods ordered. Please note that you must notify us within 12 hours of payment. Please note that you cannot cancel special bespoke orders once they have been confirmed. Please be aware a handling charge of £15 may be applicable for cancelled orders where handling, postage and packaging has ensued. You do not need to give us any reason for cancelling your order. This policy is in accordance with the EU Distance Selling (Directive 97/7) as ratified by part of the Consumer Protection (Contracts Concluded by Means of Distance Communications) Regulations 2000.

WARRANTIES

Subject to the following provisions of this section, we warrant that the products will be of satisfactory quality. The aforementioned warranty is given by MAWI Limited subject to the following condition: MAWI Limited is not under liability to the customer for any loss, damage, costs, expenses or other claims in respect of: • Any defect arising from wilful damage, negligence, failure to follow instructions for the use of the products (whether oral or in writing); • Misuse or alteration of the products without MAWI Limited's approval; • Arising from any customer materials supplied by you which is incomplete, inaccurate, illegible, out of sequence or in the wrong form, or any other fault of the customer • Products not manufactured by MAWI Limited, in respect of which the customer shall only be entitled to the benefit of any such warranty or guarantee as is given by the manufacturer to MAWI Limited. MAWI Limited's luxury quality jewellery should meet or exceed your expectations. However, in the event that you are dissatisfied with your order, the products delivered to you are incomplete or you have received incorrect items, we shall have no liability to you unless you return the goods to the address provided within 7 days of delivery of the products in question. If you notify a problem to us after the 7 day refund period, we may refer you to a local jewellery associated with MAWI Limited to rectify the fault or we may offer you an alternate product within 30 days of delivery to the same value of the goods provided that that the original product is returned to us in its original condition. Products should be returned to us in accordance with the section as stated above, without dispute. In each case, MAWI Limited will have no further liability. Please check the return and exchange section for additional information.

RETURNS

We hope you love your MAWI pieces as much as we do. However if you would like to return your purchase we are able to issue a refund or exchange up to 7 days after the date of receipt. Simply follow the guidelines below. Please note that sale items can only be returned for an exchange or credit note unless proven faulty.

REFUND

If you would like to return your MAWI purchase and receive a refund, you must first request a Retail Merchant Authorisation number (RMA). Please note that you must request an RMA within 7 days of receiving the item. How you request your RMA number will depend on or whether or not you purchased the item through a registered MAWI customer account. If you bought the item through a registered MAWI account, then simply log in to your account and view your completed order. You can then select REQUEST RETURN AUTHORIZATION NUMBER on the item(s) you wish to return. Your request will be submitted to our Customer Service Team who will determine whether or not you are legible to receive an RMA number. If you purchased your item through the Express Checkout then you must send an email to customerservice@mawi.co.uk, stating your Order Number and the item(s) you wish to return. Your Order Number is stated on the Order Confirmation email you received when you purchased the item. Your request will be submitted to our Customer Service Team who will determine whether or not you are legible to receive an RMA number. If your request is successful you will receive an RMA number by email within 48 hours. You must then return the item to the following address within 7 days to be considered for a refund. MAWI RETURNS MAWI Head Quarters Independent Place, LONDON E8 2HE. Please ensure that you clearly print your return address details on the package. The item must be sent in the same condition it was sold, and in the original packaging complete with proof of purchase and tags still intact. The package must be labelled MAWI RETURNS. We recommend insuring the package for the full amount of the invoice plus shipping charges, as well as sending the item by recorded delivery to track its progress. However MAWI Limited cannot reimburse your shipping costs and will not be held responsible for items lost or damaged in transit. We cannot issue a refund or exchange on items that are incomplete, damaged or in an otherwise used condition. If you do not return your item within 7 days we will no longer be able to offer a refund. You are still welcome to return your purchase within 28 days of receipt but we are only able to offer an exchange or credit note. Credit notes are issued in the name of the cardholder from the original purchase and are valid for 12 months. You can redeem a credit note against all full price and sale items on www.mawi.co.uk.

EXCHANGE

If you would like to exchange your MAWI purchase for another item up to or of the same value please log in to your account and view your completed order. You can then select REQUEST EXCHANGE on the item(s) you wish to return, and submit the details of the new item you would like to exchange it for. Whether or not your request will be fulfilled is subject to availability. If you purchased your item through the Express Checkout without signing in to a customer account then you must send an email to customerservice@mawi.co.uk, stating your Order Number and the item(s) you wish to return and exchange. Your Order Number is stated on the Order Confirmation email you received when you purchased the item. Whether or not your request will be fulfilled is subject to availability. Please note that you must request an exchange within 7 days of receiving the item. MAWI Limited cannot accept the exchange more than 7 days after the delivery date. Once your exchange has been confirmed you will receive an RMA number by email within 48 hours. You must then return the item to the following address within 7 days. MAWI RETURNS MAWI Head Quarters Independent Place, LONDON E8 2HE. Please ensure that you clearly print your return address details on the package. MAWI items returned to our office will be inspected by our Quality Control department on arrival. Please note that we cannot exchange items that are incomplete, damaged or in an otherwise used condition. The item must be sent in the same condition it was sold, and in the original packaging complete with proof of purchase and tags still intact. The package must be labelled MAWI RETURNS. We recommend insuring the package for the full amount of the invoice plus shipping charges, as well as sending the item by recorded delivery to track its progress. However MAWI Limited cannot reimburse your shipping costs and will not be held responsible for items lost or damaged in transit. You will be notified by email once your exchange has been cleared, and your new item will be delivered to you free of charge.

MAWI GIFT CARDS

Mawi Gift Chips and Virtual Gift Chips are sold subject to the following terms and conditions:

  1. Gift Cards are valid for 12 months from date of purchase.
  2. Gift Cards can be redeemed against all products on the www.mawi.co.uk site and in our flagship store in Shoreditch, London.
  3. Gift Cards are non transferable and may not be returned or redeemed for cash.
  4. If your order total is less than the value of the Gift Card, the remaining balance will be credited to your account and will be redeemed against subsequent orders. You may check your Gift Card balance online via your My Account page.
  5. If your order exceeds the value of the Gift Card and you have existing store credit on your account, this will automatically be redeemed to cover the remaining balance. All remaining balances exceeding the value of your gift credit or store credit must be paid by credit or debit card.
  6. If you return products you have purchased using a Gift Card, the remaining balance will be credited to your account as store credit and will be redeemed against subsequent orders. You may check your Store Credit balance online via your My Account page.
  7. Virtual Gift Cards will be e-mailed to the recipient once the full order has been processed and payment has been taken. A copy will also be sent to the sender as confirmation of dispatch.
  8. Mawi is not liable for delivery of a Virtual Gift Card to an incorrect or non-existent email address. This is the sole responsibility of the purchaser.
  9. The Mawi Gift Card is like cash: Mawi is not responsible if a Gift Card is lost, stolen, destroyed or used without permission.
  10. Mawi reserves the right to cancel a Gift Card if we deem such action necessary.
  11. Promotion codes cannot be applied to the purchase of Gift Cards with the exception of free shipping codes which can be applied to Printed Gift Cards orders.
  12. Sales tax and shipping is applicable on any products purchased with a Mawi Gift Card.
  13. Shipping is applicable on Printed Gift Cards.
  14. Refunds will not be given for the purchase of a Mawi Gift Card.

LIABILITY

Nothing in these Terms will limit MAWI Limited's liability for death or personal injury resulting from our negligence or that of our employees or agents. If you are a consumer (within the meaning of the Unfair Contract Terms Act 1977) the content of these Terms will not affect your statutory rights. Where MAWI Limited provides any information in relation to the products supplied to it by a third party, MAWI Limited does not give any warranty, guarantee as to its accuracy or otherwise and shall have no liability to the customer for any losses arising as a result thereof. In the event that MAWI Limited is unable to or fails to deliver the products ordered within any time period specified, we will use reasonable endeavours to contact you in order to re-schedule the delivery time. MAWI Limited does not warrant or guarantee the delivery date specified in the Order Confirmation and shall have no liability to you for any loss, damage, costs, expenses or other claims that you may incur as a result of late delivery. MAWI Limited will not be in breach of contract as a result of any Force Majeure event. In any event, the liability of MAWI Limited for any breach or the aggregate liability for any series of breaches under or in connection with these terms shall not exceed the value of the relevant order placed by you from time to time. MAWI Limited will hold no liability for loss of profit or for any indirect, special or consequential loss of damage, costs, expenses or other claims for compensation whatsoever arising out of or in connection with the supply or non-supply of the purchased items (including any delay in supplying the items) or their use or resale by you. Other than as set out in our returns section, the entire liability of MAWI Limited arising out of any order for items from you will be limited to the total price of the items ordered by you. You must observe and comply with all applicable regulations and legislation, including all necessary customs, import or other permits to purchase items from www.mawi.co.uk. The importation or exportation of MAWI Limited products may be prohibited by certain national laws. MAWI Limited makes no representation and accepts no liability in respect of the import or export of the items you purchase.

The entire content of the Website, including all copyright, trademarks and other intellectual property rights it contains, including the use of the name ‘MAWI Limited’ is the sole property of MAWI Limited or our licensors. You are permitted to copy, transmit and to use such material only for the purpose of ordering products from the Website, but you not are entitled to copy, reproduce, transmit, display in public, create derivative works from or otherwise commercially exploit such material. All intellectual property rights in the Products (subject to the rights of any third party) belong to MAWI Limited. You warrant that all customer material provided to us will not be defamatory or infringe the copyright or other rights of any third party, and you shall compensate MAWI Limited against any loss, damages, costs, expenses or other claims arising out of any such infringement.
